A RESOLUTION rescinding Resolution 13000, dated December 13, 1999, and authorizing the County Executive to execute Agreements with certain organizations which engage in anti-drug treatment and rehabilitation activities for the purpose of treating users of illegal drugs, at a total cost to the County not to exceed $2,233,238.03.

Body

WHEREAS, the voters of Jackson County, Missouri, renewed their sales tax for seven years to provide funding for the fight against illegal drugs in our community; and,

 

WHEREAS, the proceeds and interest generated from this tax are deposited in a special Jackson County Anti-Drug Sales Tax Trust Fund that is segregated and not commingled with the general fund or any other special funds of the County; and,

 

WHEREAS, the voters and the Legislature authorized the COMBAT Commission to contract with any organization or entity, whether public or private, which engages in anti-drug treatment and rehabilitation activities, for the purposes of treatment and rehabilitation of drug users; and,

 

WHEREAS, the COMBAT Commission, through the Purchasing Department, previously issued Request For Proposals 158-99, inviting qualified organizations to submit proposals for the providing of treatment services; and,

WHEREAS, the organizations, listed on the document attached hereto as Exhibit A, all engage in drug treatment and rehabilitation activities, and are otherwise qualified to contract with the County for the expenditure of anti-drug sales tax funds; and,

 

WHEREAS, the COMBAT Commission, with the assistance of the Prosecuting Attorney and private consultants, reviewed all of the proposals submitted by said organizations and considered staff review and comments thereon; and,

 

WHEREAS, the COMBAT Commission desires to assist these organizations in the provision of services and has recommended the expenditure of anti-drug sales tax funds for these organizations, in the respective amounts set forth on Exhibit A, to assist in the treatment and rehabilitation of drug offenders all in accordance with the criteria, review and recommendations aforesaid; and,

 

WHEREAS, by Resolution 13000, dated December 13, 1999, the Legislature previously authorized the County Executive to execute agreements with all of these organizations; and,

 

WHEREAS, due to mathematical errors, the amounts designated for each agreement were incorrect; and,

 

WHEREAS, these agreement have not been fully executed and new agreements with the appropriate amounts are being prepared; therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Resolution 13000, dated December 13, 1999, be and hereby is rescinded; and,

 

BE IT FURTHER RESOLVED that the County Executive be, and hereby is, authorized to execute agreements with the organizations and attached hereto in amounts not to exceed the amounts set forth in Exhibit A, for the purpose of preventing drug and drug-related offenses, in a general form as approved by the County Counselor; and,

 

BE IT FURTHER RESOLVED that the Director of the Department of Finance be, and hereby is, authorized to make all payments, including final payments on these agreements, to the extent sufficient funds have been budgeted.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
