Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

                                          

Section 1.  A conditional use permit is hereby granted for a period of twenty (20) years to continue operation of a Day Care Center for school age children at the Elm Grove Elementary School on a situs described as  twelve (12) ± acres generally located at the northeast corner of Kentucky and Whitney Roads and is legally described as follows:

All that part of the Southwest Quarter of Section 20, Township 50, Range 31 in Jackson County, Missouri, described as follows: Beginning at a point 25 East and 40 feet North of the Southwest corner of the Southwest Quarter of Section 20, Township 50 Range 31; thence North 0 degrees, 08 minutes, 36 seconds West parallel with the West line of said Quarter Section 723.00 feet; thence South 89 degrees, 59 minutes, 44 seconds East, parallel with the South line of said Quarter Section 723.00 feet; thence South 0 degrees, 08 minutes, 36 seconds, East 723.00 feet to a point 40.0 feet North of the South line of said Quarter Section; thence North 89 degrees, 59 minutes, 44 seconds West 723.00 feet to the point of beginning.  Containing 12.0 acres, subject to that part in roads, a/k/a 18000 Kentucky Road.

 

Section 2.  The Legislature, pursuant to the application of the Fort Osage School District (CU-2005-188), and with notice that the Jackson County Plan Commission, on March 17, 2005, held a public hearing and voted 5 to 0 to recommend APPROVAL for a twenty (20) year period, hereby adopts this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
