AN ORDINANCE approving the preliminary plat of Eagle Crest Estates, 1st Plat on       forty-four (44) ± acres creating thirteen (13) residential lots.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The preliminary plat of Eagle Crest Estates creating a thirteen (13) lot residential subdivision, is hereby approved, as to a forty-four (44) ± acre tract more specifically described as follows:

Description: The forty-four (44) ± acres are generally located the south side of Easley Road and approximately 3/4 mile west of Alley-Jackson Road and specifically described:

 

All that part of the West Half of Section 9, Township 47 North, Range 30 West of the Fifth Principle Meridian in Jackson County, Missouri described as follows:  Commencing at the Southwest Corner of the Southwest Quarter of said Section 9; thence North 02 degrees 04 minutes 02 seconds East, along the West line of said Southwest Quarter, a distance of 1220.26 feet to the POINT OF BEGINNING; thence North 02 degrees 04 minutes 02 seconds East, continuing along said West line, a distance of 1415.01 feet to a 3/8" iron bar described in Missouri DNR Document Number 600-42393 as being the Northwest Corner of the Southwest Quarter of said Section 9; thence North 89 degrees 40 minutes 44 seconds East, along the North line of said Southwest Quarter a distance of 695.95 feet; thence North 55 degrees 53 minutes 48 seconds East a distance of 439.44 feet; thence South 04 degrees 25 minutes 23 seconds West a distance of 245.18 feet to a point on the North line of the Southwest Quarter of said Section 9; thence South 01 degree 53 minutes 15 minutes West, along the West line of the North 545.67 feet of the East 270 feet of the Northwest Quarter of the Southwest Quarter of said Section 9, a distance of 546.07 feet; thence North 89 degrees 40 minutes 44 seconds East, along the South line of the North 545.6 feet of the East 270 feet of the Northwest Quarter of the Southwest Quarter of said Section 9, a distance of 270.20 feet to a point on the East line of the West One-Half of the Southwest Quarter of said Section 9; thence South 01 degree 53 minutes 15 seconds West, along said East line, a distance of 1091.39 feet; thence North 84 degrees 34 minutes 10 seconds West a distance of 776.97 feet; thence North 05 degrees 25 minutes 50 seconds  East a distance of 90.37 feet; thence North 84 degrees 34 minutes 10 seconds West a distance of 545.73 feet to the POINT OF BEGINNING.  Containing 43.81 acres, more or less.

 

 

 

Section 2. The Legislature, pursuant to the application of Salvatore Lascuola for approval of a preliminary plat and with notice that the Jackson County Plan Commission, on March 17, 2005, reviewed the preliminary plat and voted 5 to 0 to recommend APPROVAL to the County Legislature, hereby adopts this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
