AN ORDINANCE amending Chapter 55, Jackson County Code, 1984, to add a new section to be known as section 5540. relating to enforcement officers’ false information on reports.

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section A. Enacting Clause. Section 5549., Jackson County Code, 1984, is hereby enacted to read as follows:

Section 5549.1 -- Law Enforcement Officer Knowingly Including False Information in Report:

a. No law enforcement officer shall knowingly make a false material statement in any report or affidavit written by such a law enforcement officer.

b. A statement is material for the purposes of this section if, regardless of its potential admissibility at trial, it could substantially affect, or did substantially affect, the course or outcome of an investigation, a charging decision, or the outcome of any cause, matter, or proceedings.

c. It is not a violation of this section for a law enforcement officer to include a correct summary of a witness’s statements in a report even if that witness’s statement is false or potentially false.

d. For the purposes of this section, a law enforcement officer is any public servant having both the power and duty to make arrests for violations of the laws of this state or any civilian employee of a governmental agency with the power to make arrests in his or her official capacity.

Effective Date: This Ordinance shall be effective immediately upon signature by the County Executive.
