AN ORDINANCE appropriating $150,000.00 from the undesignated fund balance of the 2014 Anti-Drug Sales Tax Fund and transferring $1,000,000.00 within the 2014 General Fund and $150,000.00 within the 2014 Anti-Drug Sales Tax Fund and awarding a contract on Bid No. PW 08-2014 for the Eastern Jackson County Courthouse Renovation Project, No. 3164, to Excel Constructors, Inc., of Overland Park, KS, at a cost to the County not to exceed $6,810,939.00.

Body
WHEREAS, there is a need for additional space and major renovations to the Circuit Court in the Eastern Jackson County Courthouse in Independence; and,
WHEREAS, by Resolution 18479, dated April 14, 2014, the Legislature did authorize an agreement with Burns and McDonnell Engineering Company, Inc., of Kansas City, MO, for architectural design services for the renovation of the interior of the Eastern Jackson County Courthouse; and,
WHEREAS, plans have been completed to add five courtrooms, additional stairs for emergency access, an additional elevator, a new HVAC system, and other improvements to the structure; and,
WHEREAS, the Director of Public Works solicited proposals for this project on Bid No. PW 08-2014 and received two submissions thereon, as follows:

and,
WHEREAS, the low bid came in higher than projections and through negotiations with the lowest bidder, the project was value engineered to reduce the bid to an amount not to exceed $6,486,011.00; and,
WHEREAS, the Director of Public Works request authorization to execute any change orders up to $324,928.00, as a contingency for any unforeseen problems that may arise in the performance of this contract; and,
WHEREAS, Excel has agreed that this project will be completed under a 10 percent DBE goal; and,
WHEREAS, an appropriation and transfer are necessary to place the necessary funds for this project in the proper spending accounts; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be made from the undesignated fund balance of the 2014 Anti-Drug Sales Tax Fund and transfer within the 2014 General Fund and the 2014 Anti-Drug Sales Tax Fund:

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Acting Director of Public Works, and that the County Executive be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.
