Body
WHEREAS, there is now pending in the United States District Court for the Western District of Missouri the case of Jackson v. Jackson County Department of Corrections, No. 97-1163-CV-W-2; and,
WHEREAS, in this action, certain present and former lead corrections officers in the Department of Corrections have alleged that the County has denied them certain overtime compensation and a retroactive salary increase in violation of state and federal law; and,
WHEREAS, the County's special labor counsel, Spencer, Fane, Britt, & Browne, is defending this matter on the County's behalf and has recommended that the matter be settled for the total payment of $51,848; and,
WHEREAS, the County Counselor also recommends this settlement; and,
WHEREAS, the settlement recommended by the County Counselor and special counsel is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be and hereby is authorized to settle the case of Jackson v. Jackson County Department of Corrections, No. 97-1163-CV-W-2, now pending in the United States District Court of the Western District of Missouri for the total payment of $51,848; and,
BE IT FURTHER RESOLVED that the County Counselor be and hereby is authorized to execute any and all documents necessary to effectuate the settlement; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance be and hereby is authorized to issue checks totalling $51,848, pursuant to the specific instructions of the County Counselor.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
