A RESOLUTION authorizing the County Executive to execute a Land and Water Conservation Fund Project Amendment with the Missouri Department of Natural Resources and certain real estate conveyance documents with the Missouri Highways and Transportation Commission, in connection with the Commission's replacement of  its bridge over the Blue River at M150 Highway and Holmes Road.

Body

WHEREAS,  in connection with its project to improve M150 Highway in south Kansas City, the Missouri Highways and Transportation Commission is replacing the M150 Highway bridge over the Blue River; and,

 

WHEREAS, this bridge replacement requires the Commission to acquire title to a 1.355-acre tract of County park property in the Blue River Parkway; and,

 

WHEREAS, that park property was acquired with federal funds, restricting the property to perpetual park use, such that it can only be conveyed by the County if equivalent substitute property is also acquired; and,

 

WHEREAS, the Commission has identified a 1.575-acre tract of equivalent property and proposes to convey that tract to the County in exchange for the needed tract; and,

 

WHEREAS, the Missouri Department of Natural Resources, which administers the federal grant program, has approved this land substitution; and,

 

WHEREAS, the Commission has also requested the conveyance of a temporary construction easement over certain other adjacent park property, for use during the bridge construction, in exchange for which the Commission will pay the County $3,556.00; and,

 

WHEREAS, this transaction is in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Land and Water Conservation Fund Project Amendment with the Missouri Department of Natural Resources; and,

 

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Real Estate Purchase Agreements with the Missouri Highways and Transportation Commission; and,

 

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached General Warranty Deed and Temporary Easement for Highway Purposes in favor of the Missouri Highways and Transportation Commission; and,

 

BE IT FURTHER RESOLVED that the above-described quit-claim conveyance of substitute property by the Missouri Highways and Transportation Commission be and hereby is accepted; and,

BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute any and all other documents necessary to complete this transaction.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
