Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit is hereby approved for a period of ten (10) years to operate a child day care center at 1608 Clark Road on a certain tract of land described as follows:
Description: The east 120 feet of Lot 1, Parr Heights Subdivision lying in part of the SE 1/4 of Section 1, Township 48N, Range 31W, in Jackson County, Missouri, aka 1608 SW Clark Road.
Section 2. The conditional use permit granted by this ordinance is subject to the following condition:
1) That the applicant comply with all local, State and Federal Laws and regulations relative to the type of Day Care Center being or proposed to be operated under this Conditional Use Permit. Upon renewal of State and County permits, the applicant shall provide copies for the Public Works Development Division.
2) That the Child Day Care Center shall be limited to the maximum number of children permitted by the Missouri Department of Health or 30 children, whichever number is less.
3) That all driveways and parking areas located on subject tract be surfaced and paved.
4) That appropriately designed wastewater disposal system be located on the north side of subject tract with the understanding that if the system fails, this conditional use permit may be revoked.
5) The area designated for the on-site wastewater disposal system shall not be accessible to children.
6) The outdoor play area of the child day care facility shall be enclosed with a fence, which shall be built and maintained to a minimum of four (4) feet in height. A play area is not permitted in the required front yard.
7) No free-standing advertising sign shall be located on the premises. An unobtrusive sign displaying the situs address and name of the business may be affixed to the front of applicant's building.
Section 3. The Legislature, pursuant to the application Suzanne Enloe (CU-2002-162), requesting approval embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on June 20, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
