Body
WHEREAS, the Little Blue Valley Sewer District (the "District") operates a sewer system (the "System") pursuant to sections 204.250, et seq., RSMo, for the primary benefit of the customers within the District (the "Customers"); and,
WHEREAS, the District has established a subdistrict in accordance with section 204.565, RSMo, to include those parts of Jackson County not served by another sewer district, such subdistrict known as "Middle Big Creek Sewer Subdistrict" ("MBC"); and,
WHEREAS, the Board of Trustees of the District is a governing body of a political subdivision responsible for MBC as heretofore established by court order; and,
WHEREAS, certain customers, including Jackson County, desire to expand the existing MBC for the purpose of providing sewer services to the area described herein which services include acquiring, constructing, improving, extending and rehabilitating the System; and,
WHEREAS, the expansion of the MBC is both reasonable and necessary, and in the best interest of the citizens of the District and the MBC; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri that the Legislature hereby authorizes the filing of a Petition which will expand the Middle Big Creek Sewer Subdistrict pursuant to section 204.565, RSMo, to define the entire Middle Big Creek Sewer area as depicted on the drawing and legal description attached hereto as attachment A; and,
BE IF FURTHER RESOLVED that the Legislature agrees that the County may be joined as a Petitioner in such action and that the appropriate County officials may and should take any steps reasonably necessary toward the expansion of the MBC.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
