AN ORDINANCE appropriating $467,177.00 from the undesignated fund balance of the 2023 Grant Fund and awarding a contract for the design and construction of a new bridge in connection with Federal Project No. BRO-B048(58), East Haines Road Bridge Replacement, County Project No. 3242, to Cale Seymour Construction, LLC, of Knob Knoster, MO, at an actual cost to the County in the amount $467,177.00, under the terms and conditions of Invitation to Bid 79-22.

Body
WHEREAS, by Ordinance 5320, dated March 16, 2020, the Legislature did authorize the execution of an Agreement with the Missouri Highways and Transportation Commission (MHTC) relating to the East Haines Road Bridge Replacement, County Project No. 3242; and,
WHEREAS, this project is part of the Federal Highway Administration’s Off-System Bridge and Rehabilitation Program and will be completed in coordination with the MHTC, which provides for reimbursement of 80 percent of the project costs; and,
WHEREAS, the County’s permitted use of soft match credits will bring MHTC’s share of project costs up to the 100% level; and,
WHEREAS, the Director of Finance and Purchasing has solicited bids on Invitation to Bid No. 79-22 for the construction of this project; and,
WHEREAS, a total of ten notifications were distributed and viewed, with two responses received and evaluated from the following:

WHEREAS, pursuant to section 1054.6 of the Jackson County Code, the Directors of Finance and Purchasing and Public Works recommend the award the contract for the design and construction of the East Haines Road Bridge Replacement in connection with Federal Project No. BRO-B048(58), County Project No. 3242, to Cale Seymour Construction, LLC, of Knob Knoster, MO, for the reason that it has submitted the lowest and best bid; and,
WHEREAS, an appropriation is necessary to place the grant funds received from MHTC for this project in the proper spending account; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be and hereby is made:

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Directors of Public Works and Finance and Purchasing, and that the County Executive be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award, in forms to be approved by the County Counselor; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.
