Body

WHEREAS, Crackerneck Creek, LLC ("Crackerneck") intends to develop a tract of land of approximately 205 acres more or less located at the southwest quadrant of I-70 and I-470 (the "Project") which includes development of a Bass Pro facility and said project will create certain unavoidable impacts to the aquatic environment of the property; and,

 

WHEREAS, Crackerneck has received from the U.S. Army Corps of Engineers (the "Corps") a Clean Water Act Section 404 Individual Permit No. 200500077 (the "Permit"), which authorizes the potential dredge and fill impacts to the Corps' jurisdictional wetland and channels resulting from Crackerneck's development of the Project to be mitigated, in part, by offsite perennial and intermittent channel mitigation utilizing 8.76 acres of land located in the County's Little Blue Trace Park; and,

 

WHEREAS, Crackerneck proposes by the Mitigation Agreement ("Agreement") attached hereto as Exhibit A and incorporated herein by reference to pay $147,273.12 to the County for the County to assume the mitigation responsibilities under the Permit for a period of five (5) years; and,

 

WHEREAS, the  Director of Parks and Recreation has determined that this Agreement will benefit the citizens of Jackson County, Missouri through restoration of natural resources and will further the recommended planning goals of the Jackson County Stormwater Commission; and,

 

WHEREAS, the Director of Parks and Recreation has further determined that the operative effect of the Agreement will have no adverse effect on the County's parklands or its use; now therefore,

 

WHEREAS, the attached Agreement has been recommended by the Department of Parks and Recreation; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Mitigation Agreement with Crackerneck Creek, LLC.

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
