Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with Southwestern Bell (SBC) of San Antonio, TX, for the furnishing of a SmartTrunk Data Circuit for the Parks and Recreation Department's Telrad phone system; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that Southwestern Bell (SBC) of San Antonio, TX, is the only known supplier of SmartTrunk Data Circuits on the Telrad phone system installed at the Parks and Recreation Department; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made to Southwestern Bell (SBC) of San Antonio, TX, for the furnishing of a SmartTrunk Data Circuit in the amount not to exceed $31,839.70 for a three-year term, in an estimated amount of $10,786.90 for installation and the first year as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County any documents necessary for the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, including final yearly payment on the contract thereby made, to the extent that sufficient appropriations to the using spending agency are contained in the then current Jackson County budget.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
