Body
WHEREAS, by Resolution 17112, dated December 7, 2009, the Legislature did authorize the County Executive to execute a Supplemental Program Agreement and a Trailway License Agreement, both with the Missouri Highway and Transportation Commission, for the Little Blue Trace Multipurpose Trail Improvement project; and,
WHEREAS, pursuant to Section 5 of the Local Public Agency Manual, the Missouri Department of Transportation has requested the adoption of an ordinance rather than a resolution as the enabling legislation authorizing the execution of the proposed agreement; and,
WHEREAS, in an effort to expedite the execution of the agreements it is necessary to rescind Resolution 17112 and adopt an ordinance as the enabling legislation; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Resolution 17112, dated December 7, 2009, be and hereby is rescinded; and,
BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute the attached Supplemental Program Agreement and the attached Trailway License Agreement, both with the Missouri Highway and Transportation Commission, for the Little Blue Trace Multipurpose Trail Improvement Project.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
