BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 15 ± acre tract of land generally located less than ½ mile south of Doris Neer Road on the east side of Missouri H Highway (Outerbelt) and specifically described as:
A TRACT OF LAND LOCATED IN THE SOUTH HALF OF THE NORTHEAST QUARTER OF SECTION 5, TOWNSHIP 49 NORTH, RANGE 29 WEST, JACKSON COUNTY, MISSOURI BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER OF SAID SECTION 5; THENCE NORTH 87°18'22" WEST ALONG THE SOUTH LINE OF THE NORTHEAST QUARTER OF SAID SECTION 5, (ALL BEARINGS BASED ON MISSOURI STATE PLANE COORDINATES WEST ZONE) 2625.75 FEET TO A POINT ON THE EASTERLY RIGHT-OF-WAY LINE OF MISSOURI HIGHWAY "H" AS NOW LOCATED; THENCE ALONG SAID EASTERLY RIGHT-OF-WAY LINE ALONG A CURVE TO THE RIGHT HAVING A RADIUS OF 955.02 AND ARC LENGTH OF 184.78 FEET AND A CHORD BEARING OF NORTH 03°34'39" WEST; THENCE CONTINUING ALONG SAID EASTERLY RIGHT-OF-WAY LINE, NORTH 02°12'30" EAST, 394.24 FEET TO THE TRUE POINT OF BEGINNING; THENCE CONTINUING NORTH 02°12'30" EAST ALONG SAID RIGHT-OF-WAY LINE, 750.00 FEET TO A POINT ON THE NORTH LINE OF THE SOUTH HALF OF THE NORTHEAST QUARTER OF SAID SECTION 5; THENCE LEAVING SAID RIGHT-OF-WAY LINE, SOUTH 87°38'45" EAST, ALONG SAID NORTH LINE, 871.20 FEET; THENCE LEAVING SAID NORTH LINE, SOUTH 02°12'30" WEST, 750.00 FEET; THENCE NORTH 87°38'45" WEST, 871.20 FEET TO THE TRUE POINT OF BEGINNING CONTAINING 15.00 ACRES MORE OR LESS AND BEING SUBJECT TO ALL PUBLIC ROADS, EASEMENTS, RESERVATIONS, RESTRICTIONS, COVENANT, AND CONDITIONS OF ANY, NOW OF RECORD.
Section 2. The Legislature, pursuant to the application of by Waymond Durham (RZ-2002-273), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 4-3 to recommend disapproval of this application in a public hearing on July 18, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
