IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI
Title
A RESOLUTION authorizing the County Executive to execute a Renewal of the County's Agreement with Southwestern Bell Telephone to provide Plexar and related telephone services, for an additional term not to exceed five years, as a sole source purchase, in the estimated amount of $328,934.92 for the first year.

WHEREAS, by Resolution 8994, dated October 21, 1991, the Legislature authorized the Director of Purchasing to enter into an agreement with Southwestern Bell Telephone and Southwestern Bell Telecom for the purchase of Plexar telephone equipment, installation thereof, and service to replace the County's Focus telephone system; and,
WHEREAS, the Director of Purchasing recommends that the County renew the agreement with Southwestern Bell Telephone to provide Plexar and related telephone services for a term not to exceed 5 years; and,
WHEREAS, the Director of Purchasing has determined that Southwestern Bell Telephone is the sole source locally for this service; and,
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Jackson County Code, 1984, requires approval and notification of the Legislature on such sole source purchases over $5,000.00; and,
WHEREAS, the Renewal Agreement provides for costs estimated at $302,146.00 for these services as follows:

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the sole source purchase of the Plexar Telephone service as recommended by the Director of Purchasing is hereby approved; and,
BE IT FURTHER RESOLVED that the County Executive is hereby authorized to enter into and execute for the County any documents necessary to the accomplishment of the purchase; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, including final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.

Fiscal Note
This award is made on a need basis and does not obligate Jackson County to pay any specific amount. The availability of funds for specific purchases will, of necessity, be determined as each using agency places its order, with certification made at that time within amounts previously budgeted for the spending agency.
