AN ORDINANCE vacating a certain section of right-of-way on Stillhouse Road.

 

 

Intro

ORDINANCE # 3774, June 5, 2006

 

 

Body

WHEREAS, Kendall Rinne and Clarence and Karen Dike have requested the vacation of a certain section of right-of-way on Stillhouse Road; and,

 

WHEREAS, the legal description for the road right-of-way in question is as follows:

A 60' wide north-south right of way of Stillhouse Road from the south right of way line of Interstate Highway 70, 164 feet + south to the north right of way line of Old U.S. Highway 40 lying in Section 31, Township 49, Range 29 in Jackson County, Missouri.

 

Description: All that part of Stillhouse Road lying east of a tract described in Document 2001I64426, lying west of a tract described in Document 1761692 in Book I1661 Page 570, and lying between Old United States Highway No. 40 and Interstate Highway No. 70, in Section 31, Range 29 in Jackson County, Missouri; and,

 

WHEREAS, the section of the road in question was abandoned after the completion of I-70 and is not necessary for any County road purpose; and,

 

WHEREAS, at its meeting of May 18, 2006, the Jackson County Plan Commission took up this request and voted unanimously to recommend the vacation; and,

 

WHEREAS, it is in the best interests of the health, welfare, and safety of the citizens of the  County that the described right-of-way on Stillhouse Road be vacated; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the described right-of-way on Stillhouse Road be and hereby is vacated.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
