WHEREAS, the County did, by Ordinance 3177, dated August 27, 2001, enter into a contract with Johnson Controls, Inc., of Lenexa, KS, for the furnishing of energy performance contracting services for use by both entities at their buildings in the downtown Kansas City government complex, at an initial cost of $3,833,115.00, and a five-year cost of $4,590,333.00; and,
WHEREAS, the County did, by Resolution 14790, authorize an increase in the total cost of that contract for the completion of a comprehensive analysis and the implementation of new energy savings measures at the County facilities on the Independence Square ($1,000,000.00) and for an additional energy efficiency project at the Jackson County Courthouse in Kansas City ($250,000.00), at an aggregate additional cost to the County not to exceed $1,250,000.00, for a new total cost to the County not to exceed $5,840,333.00; and,
WHEREAS, the Director of Facilities Management has proposed an additional increase to this contract for the implementation of new energy savings measures at the Courthouse Annex in Independence to address work that was not included in the original scope of work by means of Change Order No. 1 in the amount of $40,763.00 and Change Order No. 2 in the amount of $37,361.00, and all accrued credits at an aggregate additional cost to the County not to exceed $78,124.00, and a new total cost to the County not to exceed $5,918,457.00; and,
WHEREAS, the Director of Purchasing has requested that the County Executive be authorized to execute said Change Orders; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Change Orders No. 1 and No. 2 and the increase to the aforesaid contract be and hereby is approved and the County Executive be and hereby is authorized to execute Change Orders No. 1 and No. 2 in a form to be approved by the County Counselor; and,
BE IT FURTHER RESOLVED that the Manager of the Division of Finance is authorized to make all payments, including final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
