A RESOLUTION authorizing the County Executive to execute two (2) thirty-six month Agreements with SBC - ASI Division (Southwestern Bell) to provide installation of Plexar Service and a new line, and to provide a new Data Circuit to connect the Public Work's Technology Center to the County's Data Network, as a sole source purchase, in the aggregate amount of $19,122.44 for the year 2005 and an annual aggregate amount of $15,121.44 for subsequent years, and a total contract amount of $49,365.32.

Body
WHEREAS, the Director of Purchasing recommends that the County execute two (2) thirty-six month agreements with SBC - ASI Division (Southwestern Bell) to 1) provide installation of Plexar Service and a new line, and to 2) provide a new Data Circuit to connect the Public Works Technology Center to the County's Data Network; and,
WHEREAS, the Director of Purchasing has determined that SBC - ASI Division (Southwestern Bell) is the sole source locally for these services; and,
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Jackson County Code, 1984, requires approval and notification of the Legislature on such sole source purchases over $5,000.00; and,
WHEREAS, for the year 2005 the aggregate cost of both Agreements is $19,122.44 for these services as follows:
Installation of New Line $4,001.00
(one time fee)
Annual Plexar Services $9,361.44
(36-month amount $28,084.32)
Annual Data Circuit Services $5,760.00
(36-month amount $17,280.00)
TOTAL $19,122.44
therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that these sole source Agreements with SBC - ASI Division (Southwestern Bell) in the aggregate amount of $19,122.44 for the year 2005 and in the aggregate amount of $15,121.44 for subsequent years for a total contract amount of $49,365.32, as recommended by the Director of Purchasing are hereby approved; and,
BE IT FURTHER RESOLVED that the County Executive is hereby authorized to enter into and execute for the County any documents necessary to the accomplishment of the purchase; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, including final payment on the contract.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
