BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for 99 years for a cemetery, subject to restrictions attached, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:
Description: A 15.88 acre tract of land generally located at the northeast corner of Slaughter Road and Slaughter Cemetery Private Drive lying in the East half of Section 16, Township 49, Range 30, Jackson County, Missouri more particularly described as follows: Commencing at the Southwest corner of the Southeast Quarter of said Section 16; thence North 00 degrees 05 minutes 43 seconds West along the West line of the East half of said section 2220.27 feet to the Point of Beginning; thence continue North 00 degrees 05 minutes 43 seconds West, 435.29 feet; thence 89 degrees 02 minutes 24 seconds East along the North line of said Southeast Quarter, 1312.30 feet; thence North 00 degrees 09 minutes 00 seconds East along the West line of the Southeast Quarter of the Northeast Quarter of said Section, 770.69 feet to the Southwest corner of SLAUGHTER CEMETERY; thence along the South line of SLAUGHTER CEMETERY South 89 degrees 46 minutes 30 seconds East, 252.80 feet; thence South 00 degrees 13 minutes 30 seconds West, 827.58 feet to a point of curvature; thence along said curve to the right having a radius of 175.00 feet, and arc distance of 251.68 feet to a point of tangency; thence South 82 degrees 37 minutes 30 seconds West, 1422.19 feet to the Point of Beginning. Containing 15.88 acres more or less. Subject to easements of record.
Section 2. The Legislature, pursuant to the application of Swan Lake Memorial Gardens (CU-96-011), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on October 24, 1996, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning...Attorney
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
