Body
WHEREAS, the County has asserted a claim against US Engineering for damages to a County facility and equipment at 303 W. Walnut, Independence, MO; and,
WHEREAS, upon negotiation, the County Counselor recommends a settlement in the amount of $3,500.00 to be paid by US Engineering to the County; and,
WHEREAS, the proposed settlement agreement, a copy of which is attached hereto, is in the best interests of the County and its residents; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be, and hereby is, authorized to settle the County's claim assented against US Engineering as total payment of $3,500.00, in full, final, and complete release of US Engineering and all of its employees, officers, agents, and servants as to damages incurred at the 303 W. Walnut facility; and,
BE IT FURTHER RESOLVED that the County Counselor be and hereby is authorized to execute any and all documents necessary to effect this settlement; and,
BE IT FURTHER RESOLVED that the Manager of the Division of Finance is authorized to accept the total amount of $3,500.00 pursuant to instructions of the Jackson County Counselor.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
