BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:
Description: The 11.9 ± acres is located at the southwest corner of Buckner Tarsney and Stony Point School Road and specifically described as:
A parcel of land located South of Stoney Point School Road in the SW 1/4 of the SW 1/4 of Section 11, Township 48N, Range 30W, more particularly described as follows: Commencing at the SW corner of said section; thence N01̊ 57' 30"E along the West line of said 1/4 1/4 section, a distance of 728.20 feet to the POINT OF BEGINNING; thence continuing N01̊ 57' 30"E along the West line of said 1/4 1/4 section, a distance of 559.11 feet to a point, said point being 30 feet Southerly of the center line of Stoney Point School Road as it now exists; thence concentric to and 30 feet Southerly of the center line of said road the following four courses: 1) along a curve to the right, with a radius of 870 feet, and arch distance of 1 38.68 feet, and an initial tangent bearing of S78̊ 40' 01"E; 2) S 69̊ 32' 02"E, a distance of 448.39 feet; 3) along a curve to the left, with a radius of 430 feet, and arc distance of 129.28 feet, and being tangent to last previous described course; 4) S86̊ 45' 37"E, a distance of 569.22 feet to a point, said point being 50.00 feet West of the East line of said 1/4 1/4 section; thence S01̊ 56' 41"W 50.00 feet West of and parallel to the East line of said 1/4 1/4 section, a distance of 354.12 feet; thence N87̊ 47' 14"W, a distance of 1255.70 feet to the POINT OF BEGINNING, containing 11.91 acres more or less, all being subject to easements, rights of way, and restrictions of record.
Section 2. The Legislature, pursuant to the application of Mike and Sharon Bessenbacher (RZ-2003-290), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on February 20, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
