A RESOLUTION authorizing the Trustees of the Land Trust of Jackson County, Missouri, to convey one (1) parcel of real property located in Kansas City, Missouri, to Environmental Liability Transfer, Inc., in accordance with §141.750.2, RSMo Supp. 2006.

Body

WHEREAS, section 141.750.2, RSMo Supp. 2006, authorizes the Trustees of the Land Trust of Jackson County to convey title in fee simple, for consideration less than two-thirds of the appraised value of a property, only after the consent of at least two of the Trustees' appointing authorities; and,

 

WHEREAS, the Trustees have recommended that an approximate 27-acre parcel located at the northwest corner of Bannister and Holmes Roads in the City of Kansas City, MO, be transferred to Environmental Liability Transfer, Inc., for less than 2/3 of fair market value; and,

 

WHEREAS, this parcel is located atop a series of underground caves and requires extensive remediation; and,

 

WHEREAS, the Trustees have owned this parcel since 2003, and have listed it with a commercial real estate broker since 2004; and,

 

WHEREAS, the Trustees have been offered $300,000 for the parcel, which is less than 2/3 of its $585,000 appraised value; and,

 

WHEREAS, the Trustees recommend the sale of this parcel for less than 2/3 of appraised value in order to improve the parcel's neighborhood and to make available to Land Trust funds for maintenance and upkeep of other Land Trust parcels beyond its current ability to provide; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Land Trust Trustees be allowed to convey the property described below, for an amount of less than two-thirds market value;

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
