AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from District A (Agricultural) to District RE (Residential Estates), a certain  3.3 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

 

Description:  A 3.3 acre tract of land approximately 1/4 of a mile north of Truman Road on the east side of Perry Road and specifically described as:

 

PART OF THE SOUTHEAST QUARTER OF SECTION 11, TOWNSHIP 49, RANGE 30 IN JACKSON COUNTY, MISSOURI BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:  COMMENCING AT THE SOUTHEAST CORNER OF SECTION 11, TOWNSHIP 49, RANGE 30 IN JACKSON COUNTY, MISSOURI; THENCE NORTH 00 DEGREES, 26 MINUTES, 16 SECONDS EAST, 667.84 FEET ALONG THE EAST LINE OF SAID SECTION 11; THENCE NORTH 89 DEGREES, 38 MINUTES, 49 SECONDS WEST, 888.67 FEET ALONG THE NORTH LINE OF ROBERTS ACRES AND HUTCHINSON ACRES, BOTH BEING PLATS OF RECORD IN JACKSON COUNTY, MISSOURI, TO THE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE CONTINUING  NORTH 89 DEGREES, 38 MINUTES, 49 SECONDS WEST, 440.01 FEET ALONG THE NORTH LINE OF SAID HUTCHINSON ACRES TO A POINT ON THE WEST LINE OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 11; THENCE NORTH 00 DEGREES, 42 MINUTES, 40 SECONDS EAST, 331.21 FEET ALONG THE AFOREMENTIONED WEST LINE; THENCE SOUTH 89 DEGREES, 27 MINUTES, 20 SECONDS EAST, 440.00 FEET; THENCE SOUTH 00 DEGREES, 42 MINUTES, 40 SECONDS WEST, 329.74 FEET TO THE POINT OF BEGINNING OF THIS DESCRIPTION.  THE ABOVE DESCRIBED      TRACT OF LAND CONTAINS 3.034 ACRES EXCLUSIVE OF ROAD RIGHT OF WAY, AKA 2523 PERRY ROAD.

 

Section 2.  The Legislature, pursuant to the application of William Corbett (RZ-2002-286), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on November 21, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
