IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI

 

Title

AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 64.2 ± acre tract, and approving the preliminary plat "Woodland Lake Estates," creating a seventeen-lot residential subdivision.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:  A 64.2 ± acre tract generally located 1 ½ miles south of U.S. Highway 50 on the east side of Smart Road and specifically described as:

 

All that part of the Northwest Quarter of Section 24, Township 47, Range 31 in Jackson County, Missouri being more particularly described as follows: Commencing at the Southeast Corner of the Northwest Quarter of said Section 24; thence East along the East line of said Northwest Quarter, North 00 degrees 00 minutes 28 seconds West, 1320.00 feet to the point of beginning; thence parallel to and 1320.00 feet North of the South line of said Northwest Quarter, North 89 degrees, 47 minutes, 07 seconds West 2625.08 feet to a point on the East right-of-way line of Smart Road as described by Document No. 642152 in Book 1148 at page 17, said point being 35 feet East of the West line of said Northwest Quarter; thence along the East right-of-way line of said Smart Road, parallel to and 35 feet East of the West line of said Northwest Quarter, North 00 degrees, 00 minutes, 00 seconds East, 909.79 feet to a point on the Westerly projection of the South line of Lot 1, THE CHURCH OF CHRIST ON SMART ROAD ADDITION, a subdivision in said County and State; thence along the South line of said Lot 1 and its Westerly projection thereof, South 89 degrees, 52 minutes, 39 seconds East (plat = North 87 degrees, 35 minutes, 02 seconds  West), 555.00 feet to the Southeast corner thereof; thence along the East line of said Lot 1, North 00 degrees, 00 minutes, 00 seconds East (plat = South 02 degrees, 17 minutes, 37 seconds West), 425.00 feet to the Northeast corner thereof, said point being on the north line of the Northwest Quarter of said Section 24; thence along the North line of said Northwest Quarter, South 89 degrees, 52 minutes, 39 seconds East, 1538.00 feet to a point 431.00 feet West of the Northeast corner of said Northwest Quarter; thence parallel to and 431.00 feet West of the East line of said Northwest Quarter, South 00 degrees, 00 minutes, 28 seconds East, 860 feet; thence South 41 degrees, 55 minutes, 45 seconds East, 645.10 feet to the point of beginning.  Except that part in roads.

 

Section 2.  The preliminary plat "Woodland Lake Estates," creating a seventeen-lot residential subdivision, is hereby approved.

 

Section 3. The Legislature, pursuant to the application of Brian Mueller (RZ-2002-279), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted unanimously to recommend this application in a public hearing on September 19, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
