Body
WHEREAS, emergency response to critical incidents, whether of natural or other origin, requires integrated professional management of law enforcement agencies and other governmental service providers to provide for the effective and timely use of all available resources; and,
WHEREAS, unified command of responses to such incidents is recognized as the management model to maximize the public safety response; and,
WHEREAS, on February 28, 2003 the U.S. Department of Homeland Security established the National Incident Management System ("NIMS") by Presidential Directive; and,
WHEREAS, NIMS is part of an effort to establish a single, comprehensive approach to domestic incident management to ensure that all levels of government across the Nation have the capability to work effectively together using a national approach to domestic incident management; and,
WHEREAS, the Jackson County Safety Coordinator/Emergency Management Director ("EMD") has been advised that as of October 1, 2004, all federal departments and agencies have been required to make the adoption of NIMS a condition precedent for federal emergency preparedness grants for local governments for Federal Fiscal Year 2006 and thereafter; and,
WHEREAS, the federal deadline for local governments to adopt NIMS is September 30, 2005; and,
WHEREAS, failure to adopt NIMS as the requisite emergency management system may preclude reimbursement to political subdivisions for costs expended for training and preparation for such disasters or emergencies; and,
WHEREAS, the County has already taken steps through the Sheriff's Office to provide for an effective unified command structure in response to a critical incident; and,
WHEREAS, the Safety Coordinator/EMD has already taken the initiative for the County's preparedness to respond to critical incidents; and,
WHEREAS, the Jackson County Department of Public Works will continue to work with the Jackson County Sheriff's Office and other local government resources to coordinate compliance with NIMS; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri that the National Incident Management System and the unified command model be and hereby is adopted and recognized as the policy for emergency planning and unified emergency command in preparing for and responding to disaster or critical incidents in Jackson County, Missouri; and,
BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute for the County any documents necessary for the recognition and adoption of the National Incident Management System.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
