Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with County Beverage Company of Lee's Summit, MO, in the estimated amount of $35,000 and Miller High Life Sales of Kansas City, MO, in the estimated amount of $20,000, for the furnishing of the desired brands of beer for use by the Parks and Recreation Department; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that County Beverage Company of Lee's Summit, MO and Miller High Life Sales of Kansas City, MO are the only qualified suppliers of the desired brands of beer in the Kansas City metropolitan area; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County contracts with County Beverage Company of Lee's Summit, MO and Miller High Life Sales of Kansas City, MO for the furnishing of concessions beer for the Parks and Recreation Department, in an aggregate amount not to exceed $55,000.00; and,
BE IT FURTHER RESOLVED that the Manager of the Division of Finance is authorized to make all payments, including final payment on the contracts thereby made, to the extent that sufficient appropriations to the using spending agency have been made in the current Jackson County Budget.
Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.

This award is made on a need basis and does not obligate Jackson County to pay any specific amount. The availability of funds for specific purchases will, of necessity, be determined as each using agency places its order, with certification made at that time within amounts previously budgeted for the spending agency.
