Body

WHEREAS, pursuant to  § 589.400 - § 589.425 RSMo., offenders who have committed sexual offenses and certain other offenses against victims less than 18 years old are required to register as sexual offenders with the chief law enforcement officer in their county of residence; and,

 

WHEREAS, the overall functions and effectiveness of the Sheriff's Department in enforcing sexual offender registration program compliance is in the best interest of the citizens of Jackson County; and,

 

WHEREAS, the Sheriff's Department states that Jackson County has 1,357 of 10,637 state-wide registered sex offenders which is more than any other county in Missouri; and,

 

WHEREAS, the Sheriff's Department states that 462 of the 1,357 registered sex offenders appear to have failed to comply with statutory continuing registration requirements such as reconfirming their address; and,

 

WHEREAS, the Sheriff's Department has stated that in order to enforce the sexual offender registration law, the Department needs a minimum of two (2) full-time Deputy Sheriff positions and one (1) full-time clerk position for the task of locating, notifying, and verifying where the offender lives and in addition to prepare cases to present to the Prosecutor for the issuing of arrest warrants for those offenders who refuse to comply with the law; and,

 

WHEREAS, The Office of the State Auditor prepared an Audit Report, Report No. 2002-41 (May 29, 2002), of the Missouri Sexual Offender Registration Program detailing several problems that limit the overall effectiveness of the sexual offender registration program; and,

 

WHEREAS, the County Legislature acknowledges receipt of the Audit Report, Report No. 2002-41; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the  Legislature recommends the following for the purpose of improving registration compliance:

 

Funding for and creation of  two (2) full-time Deputy Sheriff positions and one (1) full-time clerk position for the task of locating, notifying, and verifying where the offender lives and, in addition, to prepare cases to present to the Prosecutor for the issuance of arrest warrants for those offenders who refuse to comply with the law.

 

 

Enacted and Approved

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
