Body
WHEREAS, by Resolution 11295, dated May 20, 1996, the Legislature did authorize the County Executive to execute a Cooperative Agreement for Consolidated Liquor License Fee Collection with the City of Kansas City, Missouri; and,
 
WHEREAS, that 1996 Cooperative Agreement ("1996 Agreement") provided that the City will collect on the County's behalf the liquor license fees imposed by Chapter 41 of the County Code, from all business establishments which are holders of both City and County liquor licenses, in connection with the establishments' annual renewal of their City liquor licenses, or the issuance of new City and County licenses; and,
 
WHEREAS, for this service, the City has retained a one-percent service charge, which provided significant savings to the County over what the County's previous costs had been in providing these services on its own; and,
 
WHEREAS, the 1996 Agreement expired after a five-year term in 2001; and,
 
WHEREAS, the City continued to provide services under the provisions of the expired agreement and retaining the one-percent service charge; and,
 
WHEREAS, in the absence of a current agreement, there have been delays and confusion in the payment of the fees to the County on a timely basis; and,
 
WHEREAS, the City Attorney has requested that a new Cooperative Agreement be executed with similar provisions but which also provides for annual automatic renewal of the terms which should prevent delays in payments to the County in the future; and,
 
WHEREAS, the attached Cooperative Agreement provides a suitable mechanism for the  implementation of this proposal; now therefore,
 
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Cooperative Agreement for Consolidated Liquor License Fee Collection with the City of Kansas City, Missouri in a form substantially similar to the attached and approved by the County Counselor.
 
Enacted and Approved
Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
