RESOLUTION # 10886, June 19, 1995 INTRODUCED BY John Patrick Burnett, County Legislator Body WHEREAS, there is now pending in the Circuit Court of Jackson County, Missouri, the case of Paul K Ballew v. James P. Aylward, Jr., et al., Case No. CV91-12277, wherein the plaintiff seeks damages against James P. Aylward, Jr., et al., relative to the conservatorship of his estate; and,
WHEREAS, the Jackson County Counselor has recommended that it is in the best interest of the heal h, welfare, and safety of the citizens of Jackson County that all of the plaintiff's claims be set led for the payment of $24,000.00 to plaintiff, as more specifically explained and detailed to the Jackson County Legislature by the County Counselor in closed session related to this litigation; n w therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be and hereby is, authorized to settle the case of Paul K. Ballew v. James P. Aylward, Jr., et al., n the Circuit Court of Jackson County, Missouri, for a total payment of $24,000.00, in full, fina , and complete release of James P. Aylward, Jr., Jackson County, Missouri, and all of its employee , officers, agents, and servants; and,
BE IT FURTHER RESOLVED that the Manager of the Division of Finance is authorized to issue the chec of Jackson County, Missouri in the total amount of $24,000.00 to plaintiff pursuant to instructi ns of the Jackson County Counselor.
Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of he Legislature.
