AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from LB (Local Business)  to RU (Residential Urban), a certain 1.5 ±  acre tract and approving the preliminary plat "Indigo Hills," creating two commercial lots and 105 residential lots.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "LB" (Local Business) District and the "RU" (Residential Urban) District so that there will be transferred from District LB to District RU a tract of land described as follows:

Description:  A 1.5 ± acre tract of land generally located at the southwest corner of Bowlin Road and U.S. Highway 40 Eastbound Lane and more specifically described as:

 

A tract of land over the Southwest Quarter of the Southeast Quarter of Section 34, Township 49, Range 31, in Jackson County, Missouri, more particularly described as follows:

 

COMMENCING at the Southeast corner of the Southwest Quarter of the Southeast Quarter of said Section 34; thence North 1°39'17" East, along the East line of said Quarter - Quarter Section, a distance of 208.71 feet; thence North 89°26' 19" West, parallel with the South line of said Southeast Quarter Section, a distance of 208.71 feet; thence North 1°39'17" East, a distance of 243.24 feet; thence North 88°20' 43" West, a distance of 22.69 feet to the POINT OF BEGINNING; thence continuing North 88° 20' 43" West, a distance of 82.21 feet; thence North 41°57'14" West a distance of 171.43 feet; thence North 48°02' 46" East, a distance of 300.00 feet to a point on the Southwesterly right of way of U.S. Route 40, as it presently exists; thence South 41° 57' 14" East, along said right of way; a distance of 208.99 feet; thence South 48°02' 46" West, a distance of 175.00 feet; thence South 41°57' 14" East, a distance of 19.14 feet; thence South 48°02' 46" West, a distance of 65.47 feet to the POINT OF BEGINNING, containing 63,403 square feet, or 1.456 acres, more or less.

 

Section 2.  The preliminary plat "Indigo Hills," creating two commercial lots and 105 residential lots, is hereby approved.

Section 3.  The Legislature, pursuant to the application of Bennett Properties, Inc. (RZ-2002-266), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 8 to 1 to recommend this application in a public hearing on May 16, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
