AN ORDINANCE relating to the use of the southerly portion of Rankin Road as a limited access road and authorizing the County Executive to execute an agreement with adjacent property owners for gated access.

Body
WHEREAS, Rankin Road is located in the unincorporated area of southeastern Jackson County, running south from Colbern Road and dead-ending at its most southerly point as set forth in Exhibit A; and,
WHEREAS, pursuant to Article II, Section 26, of the Jackson County Charter, the County Legislature may regulate and limit access to the use of public highways and roads for the public interest and safety; and,
WHEREAS, the County has been informed by the adjacent property owners that there is a continuing problem with unauthorized dumping of trash and debris on Rankin Road which is detrimental to the environment and a potential hazard to motorists using the road; and,
WHEREAS, Doug Martin, a property owner on Rankin Road, has requested that the County declare this a limited access road and provide for use of the road by means of a gated access available to all of the adjacent property owners; and,
WHEREAS, limited access to Rankin Road will not adversely effect the rights of the citizens of Jackson County, Missouri or the transportation or safety needs of the County; and,
WHEREAS, it appears that the other adjacent property owners have expressed their support for this request and are willing to enter into an agreement regarding gated access; and,
WHEREAS, materials and equipment required for the limitation of access have been acquired under existing term and supply contracts; and,
WHEREAS, the County is willing to enter into an Agreement to provide gated access to these property owners as a temporary means of addressing the problem provided that all adjacent property owners requiring access by Rankin Road are in agreement; and,
WHEREAS, it is in the best interests of the health, welfare, and safety of the citizens of the County that Rankin Road be declared to be a limited access road subject to such limitations as may be deemed necessary by the Department of Public Works; and,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that Rankin Road be and hereby is declared to be a limited access road; and,
BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute an agreement with the adjacent property owners for gated access to the road in a form to be approved by the County Counselor.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
