IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE declaring a moratorium through September 15, 1996, on the issuance of building permits and the acceptance of applications for building permits in the unincorporated area known as the Adams Dairy Parkway Corridor. Intro ORDINANCE #2565, July 22, 1996 INTRODUCED BY Fred Arbanas, County Legislator Body WHEREAS, on June 17, 1996, the Blue Springs City Council adopted an ordinance imposing for ninety days a moratorium on the issuance of and acceptance of applications for building permits in the Adams Dairy Parkway Corridor; and, WHEREAS, the City Council took this action because it believed that before further development and construction should be allowed to occur in the corridor, the council should examine development standards and zoning issues to better facilitate and control the development; and, WHEREAS, orderly and sound development in the Adams Dairy Parkway Corridor is an important public goal which, of necessity, needs to be examined further to provide for high quality, comprehensively designed development that is well planned so as to be compatible with surrounding development; and, WHEREAS, the City has requested that the Legislature impose a similar moratorium on that portion of the corridor which lies within the unincorporated area of the County; and, WHEREAS, it is in the best interests of the citizens of Jackson County that property and building values within the Adams Dairy Parkway Corridor be protected because of the public investments made by the construction of the Parkway itself and the Blue Springs-owned golf course; and, WHEREAS, it is imperative that development be managed in a manner which encourages the most appropriate use of the land and protects against traffic congestion and overcrowding; and, WHEREAS, comprehensively designed development requires that the Blue Springs City Council and the Legislature examine further the uses to be allowed at various locations within the Adams Dairy Parkway Corridor; and, WHEREAS, a moratorium is necessary to give the Blue Springs City Council and Legislature time to examine said aforestated criteria and to develop and pass any needed changes in the zoning and development ordinances related thereto; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that there is hereby declared, through September 15, 1996, a moratorium on the issuance of building permits and the acceptance of applications for building permits in that portion of the unincorporated area of the County which lies within in Adams Dairy Parkway Corridor, legally described as follows: The East 1/2, Northwest 1/4 and the Northeast 1/4 of Section 32, T49N, R30W; and The East 1/2, Northwest 1/4 and the Northeast 1/4 of Section 33, T49N, R30W; and That part of the East 1/2, Southwest 1/4 and the Southeast 1/4 of Section 29, T49N, R30W which lies south of the south right-of-way line of Interstate 70, all in Jackson County. Section 28, T49N, R30W, lying North of I-70 & West of Tyer Road. Attorney Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
