AN ORDINANCE amending the zoning districts established pursuant to the Unified Development Code by changing from District A (Agricultural) to District RR (Residential Ranchette) a certain 10.5 + acre tract, for a two-lot residential subdivision.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:
Description:
The 10.5 ± acres are approximately 1/4 ± mile north of Happy Hollow Road on the east side of Koger Road and specifically described as all that part of the Fractional Southwest Quarter of Section 6 and the Fractional Northwest Quarter of Section 7, Township 50, Range 30, Jackson County, Missouri, more particularly described as:
Description: Commencing at the southwest corner of said Section 6; thence north 3̊09'59" east, (deed = due north) along the west line of said Section 6, 346.00 feet; thence south 87̊57'55" east (deed = due east), parallel with the south line of said Section 6, 621.28 feet; thence south 3̊00'04" west (deed = due south), 736.70 feet; thence north 87̊57'55" west (deed = due west), parallel with the north line of said Section 7, 621.28 feet to the west line of said Section 7; thence north 2̊49'33" east (deed = due north), along said west line, 357.56 feet to the northeast corner of Section 12, Township 50, Range 31; thence north 3̊49'59" east (deed = due north), continuing along said west line, 33.14 feet to the point of beginning, containing 458,033 square feet or 10.515 acres, more or less, aka 3715 N. Koger Road.
Section 2. The Legislature, pursuant to the application of Stanton Brown II (RZ-2008-449), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on April 17, 2008, does adopt this Ordinance pursuant to the Jackson
County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
