Body
WHEREAS, in connection with the Intersection Improvements, Gregory Boulevard and Lee's Summit Road Project, No. 3083, the Director of Public Works has solicited formal written bids pursuant to Bid No. PW-06-2009; and,
WHEREAS, contractors were required to submit bids for two options, one which allowed the closure of the intersection during June, July, and August, 2009, and one to construct the entire project while remaining open to traffic; and,
WHEREAS, he has received twelve (12) bids thereon, with the lowest three bids for each option as follows:

and,
WHEREAS, due to the presence of a hospital at the intersection along with the large number of motorists that would be affected be a closure, the Director of Public Works recommends award to Miles Excavating as the lowest and best bidder for open to traffic construction; and,
WHEREAS, in the event that line item adjustments to the contract become necessary, it is appropriate that the Director of Public Works be authorized to approve said line item adjustments to the extent there is no additional cost to the County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made to Miles Excavating of Kansas City, KS, at an actual cost to the County not to exceed $1,118,817.76, and that the County Executive be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of Public Works is authorized to approve line item adjustments which may become necessary under this contract to the extent there is no additional cost to the County; and,
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
