Body
WHEREAS, the Director of Public Works has solicited formal written bids on Bid No. PW 13-2004 for Colbern Road Phase III Project No. 2455; and,
WHEREAS, he has received as the lowest three bids thereon:

R.A. Knapp Construction Inc., $2,464,935.05
Kansas City (Jackson County), MO
Ideker, Inc. $2,478,640.30
St. Joseph, MO
and,
WHEREAS, the Director of Public Works has recommended that award be made to Radmacher Brothers Excavation, Pleasant Hill, Missouri, for the reason that it has submitted the lowest and best bid; and,
WHEREAS, an appropriation of $493,009.00 from the unappropriated surplus of the Special Road and Bridge Fund to an account within the Public Works Department's Engineering account for the Colbern Road Phase III, Project No. 2455, is necessary in order to enable the award of this bid contract now; therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be made from the unappropriated surplus of the 2005 Special Road and Bridge Fund in the total amount of $493,009.00 as follows:

BE IT FURTHER ORDAINED that a contract on Bid No. PW 13-2004 in the actual amount of $2,458,712.70 be awarded to Radmacher Brothers Excavation of Pleasant Hill, Missouri as the lowest and best bidder; and that the County Executive is authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER ORDAINED that the Director of Public Works be and hereby is authorized to adjust the contract line item quantities provided that, in doing so, there is no additional financial obligation to the County; and,
BE IT FURTHER ORDAINED that the Director of the Department of Finance be and hereby is authorized to make all payments, except final payment on the contract, and to encumber said money.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
