AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) for a period of twenty (20) years to continue operation of a 125 foot high radio transmission tower as to a certain 0.78 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  A conditional use permit is hereby granted for a period of twenty (20) years for the continued operation of a 125 foot high radio transmission tower as to a parcel of land at the southwest corner of Langsford Road and Milton Thompson Road legally described as follows:

Description: Lot 1 of Langsford Yard, a subdivision in Jackson County, Missouri lying in the southwest quarter of the northwest quarter of Section 1, Township 47, Range 31 aka 11010 Milton Thompson Road.

Section 2.  The Legislature, pursuant to the application of Prairie Township Fire Protection District. (CU-2004-182), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission  voted 5-0 to recommend approval of this application in a public hearing on September 16, 2004, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
