AN ORDINANCE amending the zoning districts established pursuant to the Unified Development Code by changing from District A (Agricultural) to District RR (Residential Ranchette), a certain 5 ± acre tract, for a one-lot residential subdivision to be known as "Lot 4 of Lone Hickory-3rd Plat."

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:

The 5 ± acres are approximately ½ ± mile north of Easley Road on the west side of Alley-Jackson Road and specifically described as a tract of land located in the Southeast quarter of Section 4 and the Northeast quarter of Section 9, Township 47 North of the Baseline, Range 30 West of the Fifth Principal Meridian, all in Jackson County, Missouri and being more particularly described as follows:  beginning at a 3/8" rebar (no cap), said point marking the Southeast corner of the Southwest quarter of the Southeast quarter of said Section 4; thence North 01̊52'07" East along the East line of the West half of the Southeast quarter of said Section 4, a distance of 87.42 feet; thence South 89̊58'51" West, a distance of 558.96 feet; thence South 01̊35'02" West, a distance of 390.16 feet to a point on the North line of Lot 2, LONE HICKORY 2nd PLAT, as recorded in Document No. 2002 I 0018899; thence North 89̊57'47" East, along said North line of Lot 2, a distance of 558.53 feet to an existing Mag Nail, said point marking the Northeast corner of said LONE HICKORY 2nd PLAT, said point also being on the East line of the Northwest quarter of the Northeast quarter of said Section 9; thence North 01̊35'02" East, along said East line, a distance of 302.58 feet to the Point of Beginning, including that part in road.  The above described tract contains 5.00 acres, more or less and is subject to all easements, restrictions, reservations, covenants and right of ways, recorded or unrecorded, if any.

 

 

Section 2.  The Legislature, pursuant to the application of Brian Cornwell (RZ-2007-436), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application at a public hearing on June 21, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
