A RESOLUTION partially repealing Ordinance 4312, dated May 23, 2011, transferring $73,500.00 within the 2011 Health Fund, and awarding a contract for the Animal Shelter Facility Project, No. 3119, to Straub Construction Company, Inc., of Shawnee, KS, at a cost to the County not to exceed $4,923,000.00, and authorizing the Director of Public Works to approve line item adjustments under this contract at no additional cost to the County.

Body
WHEREAS, by Ordinance 4312, dated May 23, 2011, the Legislature did award a contract on Bid No. 03-2011, for the Animal Shelter Facility Project, No. 3119, to R.L. Philips Construction, Inc., of Raymore, MO; and,
WHEREAS, R.L Philips Construction, Inc., has not been able to comply with the bid's specifications regarding bonding and is therefore unable to execute an acceptable contract for this project; and,
WHEREAS, the Director of Public Works recommends the re-award of the contract on Bid No. 03-2011 to Straub Construction, Inc., of Shawnee, KS, as the lowest and best bidder meeting the bid's specification, at a cost to the County not to exceed $4,923,000.00; and,
WHEREAS, in the event that line item adjustments to the contract become necessary, it is appropriate that the Director of Public Works be authorized to approve said line item adjustments to the extent there is no additional cost to the County; and,
WHEREAS, a transfer is necessary to cover a portion of the project costs; and,
WHEREAS, the County Executive recommends said transfer; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be and hereby is made:

BE IT FURTHER RESOLVED that the portion of Ordinance 4312, dated May 23, 2011, awarding a contract for the Animal Shelter Facility Project, No. 3119, to R.L. Philips Construction, Inc., of Raymore, MO, is hereby repealed; and,
BE IT FURTHER RESOLVED that award be made as recommended by the Director of Public Works and that the Director be, and is hereby, authorized to execute for the County any documents necessary for the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of Public Works be and hereby is authorized to make adjustments in the contract line item quantities to the extent that there will be no further funding obligation to the County; and
BE IT FURTHER RESOLVED that the Director Finance and Purchasing is authorized to make all payments, including final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
