IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE repealing Ordinance 2628, dated January 29, 1997, authorizing the exemption of the positions of probation and parole clerk typist II, probation and parole officer I, and probation and parole assistant I, all within the Missouri Department of Probation and Parole district office, from the provisions of the Merit System, and amending Schedule V to chapter 2, Jackson County Code, 1984, relating to the salaries of non-merit employees. Intro ORDINANCE 2746, October 20, 1997 INTRODUCED BY John Patrick Burnett, County Legislator Body WHEREAS, a key feature of the County's plan to reduce crowding in the Jackson County Detention Center, approved by the United States District Court for the Western District of Missouri in Hall v. Jackson County Department of Corrections, Case No. 84-1200-CV-W-1, is an increase in staffing for the Missouri Division of Probation and Parole local district office's pretrial services section; and, WHEREAS, this increased staffing will allow the office to more closely supervise more criminal defendants awaiting trial, defendants who otherwise might have to be confined in the detention center; and, WHEREAS, the Division of Probation and Parole's goal is to provide pertinent information about criminally-charged individuals to the circuit court to be utilized by the trial divisions in an effort to make decisions regarding options for release from the detention center; and, WHEREAS, the State has committed to working with the County to ensure sufficient staff are available to address and facilitate release needs of the pre-trial population, which commitment has been affirmed by all parties involved; and, WHEREAS, in order to expedite these proceedings, to supervise electronic home detention for non-alcohol-related cases, ordered by the court to be released from custody pending disposition of charges, and to provide clerical support to expedite timely processing of all information allowing all possible pre-trial releases, the Division has agreed it will hire and supervise four Jackson County employees in three positions: (2) probation and parole clerk typists II, (1) probation and parole officer I, and (1) probation and parole assistant I, within the local office, so as to provide the necessary pretrial services; and, WHEREAS, due to the temporary nature of these positions, and the hybrid hiring and supervision authority, the County Executive has requested that these three positions be exempt from the provisions of the Merit System; and, WHEREAS, at its regular meeting of June 5, 1996, the Merit System Commission considered this request and, pursuant to article IX, 21 of the Constitutional Home Rule Charter of Jackson County, has recommended these exemptions to the Legislature; and, WHEREAS, since these positions are new, it is necessary for the Legislature to establish salary ranges for the positions pursuant to article II, 16(15) of the Charter and 287. of the County Code; and, WHEREAS, the Personnel Director recommends that these positions be assigned the same salary ranges as comparable positions within the Missouri Division of Probation and Parole; and, WHEREAS, Ordinance 2628, dated January 29, 1997, which enacted a different mechanism for the implementation of this program, is no longer necessary and should be repealed; and, WHEREAS, the adoption of this ordinance is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that Ordinance 2628, dated January 29, 1997, be and hereby is repealed; and, BE IT FURTHER ORDAINED that, pursuant to article IX, 2 of the Charter, the exemption of the positions of probation and parole clerk typist II, probation and parole officer I, and probation and parole assistant I, all within the Missouri Department of Probation and Parole's local district office, from the provisions of the Merit System, be and hereby is authorized;
