AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 3 + acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:

 

A 3 ± acre tract of land generally located at the northeast corner of Courtney Road and Atherton Road and more specifically described as follows:

 

A replat of LOT 6, KOEHLER ADDITION, a subdivision in Jackson County, Missouri, and that part of the Northeast quarter of Section 18, Township 50, Range 31 in Jackson County, Missouri described as follows:

 

Beginning at the Southeast corner of the Southwest Quarter of the Northeast Quarter of said section; thence North 87 degrees 27 minutes 52 seconds West, along the South line of the Southwest Quarter (1/4) of the Northwest Quarter (1/4), a distance of 18.64 feet (deed reads North 89 degrees 31 minutes 30 seconds West); thence North 02 degrees 42 minutes 13 seconds East a distance of 11.77 feet to a point on the North right-of-way line of Courtney  Road, as now established, said point being the Southeast corner of LOT 6, KOEHLER ADDITION (deed reads North 00 degrees 38 minutes 35 seconds East); thence North 87 degrees 50 minutes 18 seconds West, along said North right-of-way line, a distance of 104.36 feet to the East line of LOT 5, KOEHLER ADDITION; thence North 02 degrees 42 minutes 13 seconds East, along the East line of said LOT 5, a distance of 197.77 feet to the Northeast corner of said LOT 5; thence North 87 degrees 30 minutes 25 seconds West, along the North line of said LOT 5, a distance of 208.71 feet to the Northwest corner of said LOT 5, deed reads North 89 degrees 34 minutes 03 seconds West); thence North 02 degrees, 42 minutes 14 second East a distance of 130.58 feet; thence South 87 degrees 30 minutes 25 seconds East a distance of 540.18 feet to a point on the centerline of Atherton Road, as now established; thence South 02 degrees 42 minutes 15 seconds East, along said centerline, a distance of 130.26 feet (deed reads South 04 degrees 45 minutes 53 seconds East); thence along a curve to the right, having a radius of 125.00 feet, a central angle of 51 degrees 21 minutes 50 seconds, along said centerline, a distance of 112.06 feet; thence South 48 degrees 39 minutes 26 seconds West, along said centerline, a distance of 156.46 feet to a point on the  South line of the Southeast Quarter (1/4) of the Northeast Quarter (1/4) (deed reads South 46 degrees 35 minutes 48 seconds West); thence North 87 degrees 27 minutes 52 seconds West, along said South line, a distance of 70.74 feet (deed reads North 89 degrees 31 minutes 30 seconds West) to the Point of Beginning.  Containing 3.00 acres more or less.

 

 

 

Section 2.  The Legislature, pursuant to the application of Munlake Properties, LLC (RZ-2000-202), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on September 21, 2000, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
