Body
WHEREAS, Stevinson Auto and Electrical School Co. is the owner of a tract of land adjacent to the Little Blue River, south of 39th Street and east of Selsa Road in Independence; and,
WHEREAS, Stevinson has been advised by its title insurance company that a small portion of its property may be located within a former channel of the Little Blue River; and,
WHEREAS,
241.300, RSMo 1994, gives the County a claim to real property located within abandoned riverbeds; and,
WHEREAS, Stevinson has been further advised that, in order for it to pass clear title to its prope ty, the potential claim of the County to this small tract must be resolved; and,
WHEREAS, the Director of the Parks and Recreation Department has advised that the small tract in question is separate and apart from the County's Little Blue Trace and that the department has o other use for the tract; and,
WHEREAS, it is thus in the best interests of the health, welfare, and safety of the citizens of t e County that the County quit-claim any interest it has in the tract in favor of Stevinson, the act al owner of the property; and,
WHEREAS, the attached Quit-Claim Deed provides a suitable mechanism for accomplishing this purpose; now therefore, BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Quit-Claim Deed in favor of Stevins n Auto and Electrical School Co.
Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of he Legislature.
