Body
WHEREAS, the Kenneth Road Bridge over the Blue River is located at the western corporate limits of Jackson County and the City of Kansas City, Missouri ("the City"), at the eastern city limits of Overland Park, Kansas, and adjacent to property owned by Loch Lloyd Country Club; and,
WHEREAS, the Kenneth Road Bridge is in poor condition and is closed to traffic; and,
WHEREAS, the County, the Cities of Kansas City, Missouri, and Overland Park, Kansas, and Loch Lloyd Country Club desire to replace the Kenneth Road Bridge; and,
WHEREAS, the City will lead and manage the bridge replacement project and will contribute $470,000.00 to the project, Overland Park will contribute $470,000.00, Loch Lloyd will contribute $100,000.00, and Jackson County will consent to the allocation of $3,000,000.00 from the Off-System Bridge Funds Program earmarked for projects within Jackson County; and,
WHEREAS, the Off-System Bridge Funds are not County funds but rather federal funds in the custody and control of the Missouri Highways and Transportation Commission that are allocated to all Missouri Counties for eligible bridge projects; and,
WHEREAS, the Kenneth Road Bridge replacement project meets the requirements for the Off-System Bridge Funds; and,
WHEREAS, the attached Interlocal Cooperative Agreement between Jackson County, the City of Kansas City, Overland Park, KS, and Loch Lloyd Country Club is a suitable mechanism by which to implement the mutual understanding and obligations of the parties regarding the Kenneth Bridge replacement; and,
WHEREAS, execution of the attached Agreement is in the best interest of the health, safety, and welfare of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri that the County Executive be and hereby is authorized to execute an Interlocal Cooperative Agreement with the Cities of Kansas City, Missouri, Overland Park, Kansas, and Loch Lloyd Country Club for the Kenneth Road Bridge Replacement, in a form substantially similar to that attached to be approved by the County Counselor.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
