AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RR (Residential Ranchette), a certain 36.5 ± acre tract, and approving the preliminary plat "Osage Highlands, Lots 8 thru 14," creating a seven-lot residential subdivision.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:

Description: The 36.5 ± acres is west of 150th Street which intersects with County Line Road and more specifically described as:

 

A portion of the Northeast Quarter of Section 33, Township 47, Range 29, Jackson County, Missouri described as follows: Commencing at the Northeast corner of Section 33; thence  S 2̊26'39"W along the East line of Section 33 for 2012.90 feet; thence N 87̊50'10"W parallel to the North line of Section 33 for 1362.64 feet to the Southwest corner of OSAGE HIGHLANDS LOTS 2 THRU 7, for the Point of Beginning; thence continue N 87̊50'10"W for 1343.05 feet to the West line of the Northeast Quarter Section 33; thence N 2̊17'18"E along said West line for 1814.34 feet; thence S 43̊06'06"E for 1194.36 feet; thence Northeasterly along a curve to the right, radius 60.00 feet, tangent bearing N 46̊53'54"E, delta 132̊46'53", for 139.05 feet tangent to a curve to the left; thence along said curve, radius 25.00 feet, delta 49̊40'47", for 21.68 feet; thence S 50̊00'00"E to and along the Westerly line of OSAGE HIGHLANDS LOTS 2 THRU 7, for 385.19 feet tangent to a curve to the left; thence along said curve, radius 320.00 feet, delta 10̊30'00", for 58.64 feet; thence S 60̊30'00"E for 50.00 feet; thence S 29̊30'00"W for 60.00 feet; thence S 60̊30'00"E for 100.00 feet tangent to a curve to the left; thence along said curve, radius 380.00 feet, delta 2̊48'29", for 18.62 feet; thence S 22̊09'50"W for 218.19 feet tangent to a curve to the left radius 380.00 feet; delta 20̊00'00", for 132.65 feet; thence S 2̊09'50"W for 182.29 feet to the Point of Beginning.

 

 

Section 2.  The preliminary plat "Osage Highlands, Lots 8 thru 14," creating a seven-lot residential subdivision, is hereby approved.

 

Section 3.  The Legislature, pursuant to the application of Mike Raysik (RZ-2003-323), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on October 16, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
