A RESOLUTION directing the Legislative Auditor to redefine the scope of the audit of the Jackson County Detention Center Annex project directed by Resolution 12794, and authorizing the County Executive to retain an independent "Big 5" accounting firm to audit the financial transactions and accounts relating to the management and operation of the project, including the Population Control Management Program, at a cost to the County not to exceed $10,000.00.

Body
WHEREAS, by Resolution 12794, dated June 25, 1999, the Legislature did direct the Legislative Auditor to audit all financial transactions and accounts relating to the management, construction, and operation of the Jackson County Detention Center Annex Project, including the Population Control Management Program; and,
WHEREAS, by Resolution 12794, the Legislature also requested the State Auditor to render whatever assistance in this audit she deems appropriate; and,
WHEREAS, since the adoption of Resolution 12794, the County Executive has advised the Legislature that, due to her concerns about the timeliness of this audit and the State Auditor's lack of impartiality, she has engaged the County's independent auditor, KMPG Peat Marwick, to audit the same transactions and accounts; and,
WHEREAS, the Legislature now believes that all of these duplicative efforts may not be in the County's best interests; and,
WHEREAS, the Legislature still desires that an audit of the financial transactions and accounts relating to the construction of the project should be conducted by the Legislative Auditor and State Auditor, but that the audit of the operation and management of the project, including the Population Control Management Program, should be conducted by another independent "Big 5" accounting firm; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislative Auditor is hereby directed to redefine the scope of her audit so as to examine only the financial transactions and accounts relating to the construction of the Jackson County Detention Center Annex Project; and,
BE IT FURTHER RESOLVED that the County Executive be and hereby is requested to immediately terminate the contracts with KMPG Peat Marwick for the audits of the Detention Center Project; and,
BE IT FURTHER RESOLVED that it is the intention of the Legislature that KMPG Peat Marwick and the Missouri State Auditor's Office be fully compensated for their work done on the audits in question prior to the adoption of this Resolution; and,
BE IT FURTHER RESOLVED that the County Executive is authorized to retain a "Big 5" accounting firm, agreeable to the Legislature, to audit all financial transactions and accounts relating to the management and operation of the Jackson County Detention Center Annex Project, including the Population Control Management Program, at a cost to the County not to exceed $10,000.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
