BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "LB" (Local Business) District and the "RU" (Residential Urban) District so that there will be transferred from District RU to District LB a tract of land described as follows:
Description: A 0.5 ± acre tract of land generally located at the southwest corner of Bowlin Road and U.S. Highway 40 Eastbound Lane and more specifically described as:
A tract of land over the Southwest Quarter of the Southeast Quarter of Section 34, Township 49, Range 31, in Jackson County, Missouri, more particularly described as follows:
COMMENCING at the Southeast corner of the Southwest Quarter of the Southeast Quarter of said Section 34; thence North 1°39'17" East, along the East line of said Quarter - Quarter Section, a distance of 208.71 feet; thence North 89°26' 19" West, parallel with the South line of said Southeast Quarter Section, a distance of 208.71 feet to the POINT OF BEGINNING; thence North 1°39'17" East, a distance of 243.25 feet; thence North 88°20'43" West, a distance of 22.69 feet; thence South 48°02'46" West, a distance of 65.47 feet; thence Southwesterly along a curve to the left, having a radius of 300.00 feet, and being tangent to the last described course, an arc distance of 162.81 to a point of reverse curvature; thence continuing Southwesterly along a curve to the right, having a radius of 200.00 feet, an arc distance of 22.28 feet; thence South 66°39'59" East, a distance of 152.20 feet to the POINT OF BEGINNING, containing 21,939 square feet, or 0.504 acres, more or less.
Section 2. The Legislature, pursuant to the application of Bennett Properties, Inc (RZ-2002-267), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 8 to 1 to recommend this application in a public hearing on May 16, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
