AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RS (Residential Suburban), a certain 1 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RS" (Residential Suburban) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description: 

A 1 ± acre tract of land approximately ½ mile south of Ryan Road on the east side of Stony Point Road and specifically described:

 

A PART OF THE EAST ONE-HALF OF THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 48, RANGE 30 IN JACKSON COUNTY, MISSOURI BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 48, RANGE 30 IN JACKSON COUNTY, MISSOURI; THENCE NORTH 87 DEGREES, 28 MINUTES, 28 SECONDS WEST, 546.22 FEET ALONG THE SOUTH LINE OF THE NORTHWEST QUARTER OF SAID SECTION 10 TO THE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE CONTINUING NORTH 87 DEGREES, 28 MINUTES, 28 SECONDS WEST, 780.00 FEET ALONG THE AFOREMENTIONED SOUTH LINE TO THE SOUTHWEST CORNER OF THE EAST ONE-HALF OF THE NORTHWEST QUARTER OF SAID SECTION 10; THENCE NORTH 01 DEGREE, 54 MINUTES, 22 SECONDS EAST, 574.68 FEET ALONG THE WEST LINE OF THE EAST ONE-HALF OF SAID NORTHWEST QUARTER SECTION; THENCE SOUTH 87 DEGREES, 28 MINUTES, 28 SECONDS EAST, 780.00 FEET; THENCE SOUTH 01 DEGREE, 54 MINUTES, 22 SECONDS WEST, 574.68 FEET TO THE POINT OF BEGINNING OF THIS DESCRIPTION.  THE ABOVE DESCRIBED TRACT OF LAND CONTAINS 9.083 ACRES EXCLUSIVE OF ROAD RIGHT OF WAY AND ROAD RIGHT OF WAY CONTAINS 1.431 ACRES.  ALL BEING SUBJECT TO THE ROAD RIGHT OF WAY, EASEMENTS AND RESTRICTIONS OF RECORD, IF ANY, AKA 31206 STONY POINT SCHOOL ROAD.

 

Section 2.  The Legislature, pursuant to the application of Walter Terry (RZ-2003-309), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on July 17, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
