AN ORDINANCE appropriating $392,500.00 from the undesignated fund balance of the 2015 Public Building Corporation Capital Project Fund and authorizing the County Executive to execute an Amendment to the contract with Excel Constructors of Overland Park, KS, for the furnishing of additional work related to the Jackson County Municipal Court located at the Eastern Jackson County Courthouse, at an additional cost to the County not to exceed $392,500.00.

Body
WHEREAS, by Resolution 18479, dated April 14, 2014, the Legislature did authorize an agreement with Burns and McDonnell Engineering Company, Inc., of Kansas City, MO, for architectural design services for the renovation of the interior of the Eastern Jackson County Courthouse; and,
WHEREAS, by Ordinance 4680, dated October 20, 2015, the Legislature did authorize the County Executive to execute a contract with Excel Constructors of Overland Park, KS, on Bid No. PW 08-2014 for the Eastern Jackson County Courthouse Renovation Project, No. 3164, at a cost to the County not to exceed $6,810,939.00; and,
WHEREAS, the Director of Public Works has identified some additional improvements necessary to the operations of the County Municipal Court, located within the Eastern Jackson County Courthouse; and,
WHEREAS, the improvements include a larger courtroom to accommodate larger dockets and additional offices for use by the Municipal Court Judge, Prosecuting Attorney, and Court staff; and,
WHEREAS, an appropriation is necessary to place the funds needed for this additional work in the appropriate spending account; and,
WHEREAS, the County Executive recommends said appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the undesignated fund balance of the 2015 Public Building Corporation Capital Project Fund be and hereby is made:

BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute an appropriate Amendment to the contract with Excel Constructors of Overland Park, KS, in a form to be approved by the County Counselor, and any documents necessary to the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract and amendments thereto.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
