Body
WHEREAS, by Resolution 12950, dated November 22, 1999, the Legislature authorized a contract with Health Productivity Systems of Kansas City, MO, for the furnishing of urinalysis testing for use by the Prosecuting Attorney's Deferred Prosecution and Drug Court programs; and,
WHEREAS, by a First Addendum to Agreement dated September 5, 2000, the terms of said contract were extended; and,
WHEREAS, the Legislature did, by Resolution 13657, dated April 9, 2001, authorize a Second Addendum to the Agreement, increasing the contract in the amount of $160,000.00 and extending the terms of the Agreement for an additional twelve months; and,
WHEREAS, by Resolution 14260, dated July 15, 2002, the Legislature did authorize a Third Addendum to the Agreement, increasing the contract in the amount of $14,500.00 and extending the terms of the Agreement; and,
WHEREAS, by Resolution 14320, dated September 16, 2002, the Legislature did authorize a Fourth Addendum to the Agreement, increasing the contract in the amount of $30,000.00 and extending the terms of the Agreement; and,
WHEREAS, the Prosecuting Attorney has recommended an increase to this contract in the amount of $24,573.00, in order to allow Health Productivity Systems to continue providing urinalysis services to participants of the Deferred Prosecution and Drug Court programs; and,
WHEREAS, the attached Fifth Addendum to Agreement provides a suitable mechanism by which to implement the Prosecuting Attorney's recommendation in this regard; therefore,
WHEREAS, a transfer within the 2002 Anti-Drug Sales Tax Fund is necessary to fund the Fifth Addendum to the Agreement with Health Productivity Systems, Inc; and,
WHEREAS, the County Executive has recommended said transfer; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be made within the 2002 Anti-Drug Sales Tax Fund:

BE IT FURTHER RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Fifth Addendum to Agreement with Health Productivity Systems; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance be and hereby is authorized to make all payments on the Agreement, as amended.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
