A RESOLUTION expressing the intent of the Legislature to cap Jackson County's tax for  E-911 emergency telephone service at the rate of 3% of the local tariff rate through calendar year 2009.

Body

WHEREAS, by Ordinance 3771, dated May 22, 2006, the Legislature did submit to the qualified voters of the County at the primary election to be held August 8, 2006, Question 1 which, if adopted, would authorize the Legislature to reimpose the County's tax for E-911 emergency telephone service in the County at a rate not to exceed 7% of the local telephone service tariff rate; and,

 

WHEREAS, under Missouri Law the proceeds of this tax can only be used for the expenses of the day-to-day operations of and improvements and enhancements to the E-911 service, which is administered by the Mid America Regional Council (MARC); and,

 

WHEREAS, the Legislature believes that the favorable passage of this question is necessary for the public health, welfare, and safety, because E-911 costs have increased in recent years and the system has been greatly enhanced, but Missouri law provides no mechanism to require cellular telephone customers to share these costs; and,

 

WHEREAS, it is the intent of the Legislature to fix the tax at the minimum rate necessary to pay for the actual costs of operating the E-9ll system, as recommended by MARC; and,

 

WHEREAS, while the Legislature believes that voter approval of Jackson County Question 1 on August 8, 2006, provides the County with needed flexibility over the medium to long term, review of the E-911 system's requirements, existing fund balance, and revenue projections causes the Legislature to believe that all needs of the E-911 system through calendar year 2009 can be met by the imposition of an E-911 tax at a maximum rate of 3% of the local tariff rate; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, MO, that it is the intent of the Legislature, assuming the successful adoption of Question 1 at the primary election on August 8, 2006, to impose the E-911 emergency telephone tax at the maximum rate of 3% of the local telephone tariff rate through calendar year 2009.

 

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
