A RESOLUTION authorizing an Addendum to Lease Agreements between the Jackson County Sports Complex Authority and the Kansas City Royals Baseball Corporation and the Kansas City Chiefs Football Club, Inc., revising Article VII Section 7.06 relating to the Jackson County Preference, which will extend priority seating privileges to the residents of those counties that are members of the Bistate Metropolitan District and approve the Bistate II question.

WHEREAS, by Resolution 8137, dated January 19, 1990, the Legislature did approve the current leases between the Jackson County Sports Complex Authority and the Kansas City Chiefs Football Club, Inc., and Kansas City Royals Baseball Corporation for the operation of Arrowhead and Kauffman Stadiums at the County's Harry S Truman Sports Complex which will expire in the year 2015; and,

 

WHEREAS, Article VII Section 7.06 of said leases gives priority seating privileges to Jackson County residents for professional baseball and football games; and,

 

WHEREAS, the Kansas and Missouri Metropolitan Culture District Compact (the "Bistate Compact"), codified at K.S.A. 12-2536 et seq. and sections 70.500 et seq., RSMo, and approved by the United States Congress, authorized the creation of the  Kansas and Missouri metropolitan culture district ("Bistate Metropolitan District") as a political subdivision of the two states; and,

 

WHEREAS, pursuant to the Bistate Compact and based upon the approval of participation in the Bistate Metropolitan District by the voters of Jackson County, Missouri, Johnson County, Kansas, Wyandotte County, Kansas, Platte County, Missouri and Clay County, Missouri, the Bistate Metropolitan District has been legally authorized and created; and,

 

WHEREAS, those counties that are or become part of  the  Bistate Metropolitan District, in order to serve the best interests of their citizenry, are authorized to cooperate to fully utilize and improve metropolitan cultural facilities, coordinate the services of metropolitan cultural organizations, enhance the cultural activities of their citizens, and achieve solid financial support for cultural facilities, organizations and activities comparable to that provided in other major metropolitan areas; and,

 

WHEREAS, Kauffman Stadium and Arrowhead Stadium are metropolitan assets that have made and will continue to make a substantial contribution to economic activity and the quality of life in the Kansas City metropolitan area if extensive renovations are performed to keep the stadiums competitive with the new or substantially remodeled sports facilities that exist in other major-league metropolitan areas; and,

 

WHEREAS, at the general election to be held on November (date), 2004, the voters of Jackson County, Missouri, Johnson County, Kansas, Wyandotte County, Kansas, Platte County, Missouri and Clay County, Missouri, will consider the question (the Bistate II Plan) of whether to authorize the imposition of a retail sales tax in the amount of one-fourth (1/4) of one cent (.25%) to support renovations to Kauffman and Arrowhead Stadiums and to provide financial assistance to metropolitan and local arts and cultural facilities, organizations, and activities; and,

 

WHEREAS, the residents of all of the counties which adopt the Bistate II Plan should receive equal consideration with regard to use of the facilities funded by the Plan; and,

 

WHEREAS, upon passage of the Bistate II Plan, residents of all counties which have authorized the Bistate II Plan, should be entitled to the priority seating privilege previously extended exclusively to Jackson County, Missouri residents and Article VII Section 7.06 of the lease agreements with the Kansas City Royals Baseball Corporation and the Kansas City Chiefs Football Club, Inc., should be amended to reflect this benefit; now therefore, 

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and is hereby authorized to execute an Addendum to Lease Agreements with the Kansas City Royals Baseball Corporation and the Kansas City Chiefs Football Club, Inc., extending the priority seating privilege to residents of those counties which have adopted the  Bistate II Plan, in a form to be approved by the County Counselor.

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
